We examine recent evolution in corporate responsibility in the forest industry, an important natural-resource-based industry which is under rapid internationalisation and structural change under challenging financial pressures. We address two recent trends in corporate communication: corporate disclosure, that is the adoption of consistent external reporting standards [namely the Global Reporting Initiative (GRI) ], and the growing awareness of engagement with and impact on local communities through philanthropy, generation of prosperity, communication and the social impact of core activities. This study uses (...) a comparative qualitative case approach to forest industry multinational enterprises (MNEs) based on a combination of secondary (reporting, company newsletters and other documentation) and interview data. Three large-scale multinational forest industry firms, all pursuing different strategies in terms of internationalisation and geographical and product diversification, were chosen for the study: Stora Enso, SCA and Sappi Ltd. Our results show that the overall quality of sustainability reporting has improved in these companies from 2005 to 2009 with the adoption of GRI. However, based on our fourfold categorisation of social impact, the core social impact indicator in GRI (SO1) has been interpreted very differently in these MNEs, and the adoption of GRI has not actually much improved the comparability of the reports or transparency of practices. It has been debated whether the so-called attention economy, in which the attention of agents is measured and sold, jeopardizes something of value. One strand of this discussion has focused on so-called attention rights, asking: should attention be legally protected, either by introducing novel rights or by extending the scope of pre-existing rights? In this paper, however, in order to further this discussion, we ask: How is attention already protected legally? In what situations does a person have the right to (...) attention under current law? -/- Unlike (Chomanski, Neuroethics 16:1–11, 2023), who discusses an overall right to attention, or (Puri, Rutgers Law Record 48:206–221, 2021), who discusses an overall right to attentional privacy, in this paper we focus on two types of situations in which a person’s attention is already protected by legal regulation. Sustained attention-requiring tasks can be jeopardized by distractions whereas attentiveness to certain kind of stimuli can be jeopardized by immersive stimuli. That is why distractions are regulated in situations where an agent has what we call a concentration right and immersive stimuli are regulated in situations where an agent has what we call a duty to be attentive. The further analysis of these situations provides an understanding of the legal means by which attention is already regulated, which can be helpful when thinking about how it should be regulated in the future. The concept of suffering is discussed among those who are cognitively aware and verbally capable to express their suffering. Due to immaturity, preterm infants’ abilities to express suffering are limited. Relieving suffering is an ethical and juridical demand of good nursing care. The purpose of this study is to describe nurses’ perceptions of the suffering of preterm infants. A descriptive qualitative approach was selected. Data were collected from essays written by nurses (n = 19) working in the neonatal intensive care (...) unit. Inductive content analysis guided by the research question was performed. The nurses described individually determined suffering of the preterm infants according to four categories: suffering ruled by maturation, existence of suffering, individual threshold of suffering and interpreting the cues of suffering. Suffering of preterm infants is manifested by population-specific features, emphasising the need to develop sensitive interventions for relieving their suffering. (shrink)

Background:Nurses’ collegiality is topical because patient care is complicated, requiring shared knowledge and working methods. Nurses’ collaboration has been supported by a number of different working models, but there has been less focus on ethics.Aim:This study aimed to develop nurses’ collegiality guidelines using the Delphi method.Method:Two online panels of Finnish experts, with 35 and 40 members, used the four-step Delphi method in December 2013 and January 2014. They reformulated the items of nurses’ collegiality identified by the literature and rated based (...) on validity and importance. Content analysis and descriptive statistical methods were used to analyze the data, and the nurses’ collegiality guidelines were formulated.Ethical considerations:Organizational approval was received, and an informed consent was obtained from all participants. Information about the voluntary nature of participation was provided.Results:During the first Delphi panel round, a number of items were reformulated and added, resulting in 32 reformulated items. As a result of the second round, 8 of the 32 items scored an agreement rate of more than 75%, with the most rated item being collegiality means that professionals respect each other. The item with second highest rating was collegiality has a common objective: what is best for patients, followed by the third highest which was professional ethics is the basis of collegiality.Conclusion:Nurses’ collegiality and its content are well recognized in clinical practice but seldom studied. Collegiality can be supported by guidelines, and nurses working in clinical practice, together with teachers and managers, have shared responsibilities to support and develop it. More research in different nursing environments is needed to improve understanding of the content and practice of nursing collegiality. (shrink)

Review of Anne Heith's Laestadius and Laestadianism in the Contested Field of Cultural Heritage: A Study of Contemporary Sámi and Tornedalian Texts.

Non-naturalism – roughly the view that normative properties and facts are sui generis and incompatible with a purely scientific worldview – faces a difficult challenge with regard to explaining why it is that the normative features of things supervene on their natural features. More specifically: non-naturalists have trouble explaining the necessitation relations, whatever they are, that hold between the natural and the normative. My focus is on Stephanie Leary's recent response to the challenge, which offers an attempted non-naturalism-friendly explanation for (...) the supervenience of the normative on the natural by appealing to hybrid properties, the essences of which link them to both natural and sui generis normative properties in suitable ways. I argue that despite its ingenuity, Leary's solution fails. This is so, I claim, because there are no hybrid properties of the sort that her suggestion appeals to. If non-naturalists are to deal with the supervenience challenge, they will have to find another way of doing so. (shrink)

Since its publication in 1967, van Heijenoort’s paper, “Logic as Calculus and Logic as Language” has become a classic in the historiography of modern logic. According to van Heijenoort, the contrast between the two conceptions of logic provides the key to many philosophical issues underlying the entire classical period of modern logic, the period from Frege’s Begriffsschrift (1879) to the work of Herbrand, Gödel and Tarski in the late 1920s and early 1930s. The present paper is a critical reflection on (...) some aspects of van Heijenoort’s thesis. I concentrate on the case of Frege and Russell and the claim that their philosophies of logic are marked through and through by acceptance of the universalist conception of logic, which is an integral part of the view of logic as language. Using the so-called “Logocentric Predicament” (Henry M. Sheffer) as an illustration, I shall argue that the universalist conception does not have the consequences drawn from it by the van Heijenoort tradition. The crucial element here is that we draw a distinction between logic as a universal science and logic as a theory. According to both Frege and Russell, logic is first and foremost a universal science, which is concerned with the principles governing inferential transitions between propositions; but this in no way excludes the possibility of studying logic also as a theory, i.e., as an explicit formulation of (some) of these principles. In the popular and academic literature on the problems of the so-called attention economy, the cost of attention grabbing, sustaining, and immersing digital medias has been addressed as if it touched all people equally. In this paper I ask whether everyone has the same resources to respond to the recent changes in their stimulus environments caused by the attention economy. I argue that there are not only differences but disparities between people in their responses to the recent, significant increase in (...) the degree and persuasiveness of digital distraction. I point toward individual variance in an agent’s top-down and bottom-up attention regulation, and to further inequality-exacerbating variance in active participation on the internet and in regulating reward-seeking behaviors on the internet. Individual differences in these areas amount to disparities because they have been found to be connected to socioeconomic background factors. I argue that disparities in responding to digital distraction threaten fair equality of opportunity when it comes to digital distraction in the classroom and that they may lead to an unequal contribution of achievements that require complex cognition by people from lower socioeconomic backgrounds. In bioethics vaccine refusal is often discussed as an instance of free riding on the herd immunity of an infectious disease. However, the social science of vaccine refusal suggests that the reasoning behind refusal to vaccinate more often stems from previous negative experiences in healthcare practice as well as deeply felt distrust of healthcare institutions. Moreover, vaccine refusal often acts like an exit mechanism. Whilst free riding is often met with sanctions, exit, according to Albert Hirschman’s theory of exit and (...) voice is most efficiently met by addressing concerns and increasing the quality and number of feedback channels. If the legitimate grievances responsible for vaccine refusal are not heard or addressed by healthcare policy, further polarization of attitudes to vaccines is likely to ensue. Thus, there is a need in the bioethics of vaccine refusal to understand the diverse ethical questions of this inflammable issue in addition to those of individual responsibility to vaccinate. This work offers a new theory of what it means to be a legal person and suggests that it is best understood as a cluster property. The book explores the origins of legal personhood, the issues afflicting a traditional understanding of the concept, and the numerous debates surrounding the topic.

What does it mean to intentionally not perform an action? Is it possible to not perform an action out of resistant intention? Is there sufficient language for talking about this kind of behavior in the social sciences? In this article, a nonnormative vocabulary of not doings including resistant intentional omissions is developed. Unlike concepts that describe official, overt, and public resistance, James Scott’s everyday resistance and Albert Hirschman’s exit have made it possible to talk about the resistant inactions of agents (...) in the social sciences. But in order to grasp the ordinariness of this kind of oppositional behavior, philosophy of intentional omissions is used. (shrink)

This article introduces a new formulation of the interest theory of rights. The focus is on ‘Bentham’s test’, which was devised by Matthew Kramer to limit the expansiveness of the interest theory. According to the test, a party holds a right correlative to a duty only if that party stands to undergo a development that is typically detrimental if the duty is breached. The article shows how the entire interest theory can be reformulated in terms of the test. The article (...) then focuses on a further strength of the interest theory, brought to the fore by the new formulation. In any Western legal system, the tortious maltreatment of a child or a mentally disabled individual results in a compensatory duty. The interest theory can account for such duties in a simple and elegant way. The will theory, on the other hand, struggles to explain such compensatory duties unless it abandons some of its main tenets. (shrink)

This edited work collates novel contributions on contemporary topics that are related to human rights. The essays address analytic-descriptive questions, such as what legal personality actually means, and normative questions, such as who or what should be recognised as a legal person. As is well-known among jurists, the law has a special conception of personhood: corporations are persons, whereas slaves have traditionally been considered property rather than persons. This odd state of affairs has not garnered the interest of legal theorists (...) for a while and the theory of legal personhood has been a relatively peripheral topic in jurisprudence for at least 50 years. As readers will see, there have recently been many developments and debates that justify a theoretical investigation of this topic. Animal rights activists have been demanding that some animals be recognized as legal persons. The field of robotics has prompted questions about driverless cars: should they be granted a limited legal personality, so that the car itself would be responsible for damages? This book explores such concepts and touches on matters of bioethics, animal law and medical law. It includes matters of legal history and appeals to both legal scholars and philosophers, especially those with an interest in theories of law and the philosophy of law. (shrink)

Eerik Lagerspetz analysoi kirjassaan Social Choice and Democratic Values laajasti äänestyssääntöjen vaikutusta demokraattisiin päätöksiin. Lagerspetzin teos on tärkeä monestakin syystä, mutta erityisesti siksi, että se yhdistää harvoin keskenään keskustelevia normatiivisen demokratiateorian ja sosiaalisen valinnan teorian perinteitä. This is a draft of a chapter for the Routledge Handbook of Metaethics, edited by David Plunkett and Tristram McPherson. I offer an overview of hybrid views in metaethics, with main focus on hybrid cognitivist views such as those defended by Daniel Boisvert and David Copp, and on hybrid expressivist views such as those defended by Michael Ridge and myself.

Many philosophers believe that judgments about propositional attitudes, or about which mental states are expressed by which sentences, are normative judgments. If this is so, then metanormative expressivism must be given expressivist treatment. This might seem to make expressivism self-defeating or worrisomely circular, or to frustrate the explanatory ambitions central to the view. I argue that recent objections along these lines to giving an expressivist account of expressivism are not successful. I shall also suggest that in order to deal with (...) these worries, Dreier's influential response to the so-called ‘problem of creeping minimalism’ must be slightly revised. (shrink)

Theories of deliberative democracy maintain that outcomes of democratic deliberation are fairer than outcomes of mere aggregation of preferences. Theorists of impartial justice, especially Rawls and Sen, emphasize the role of deliberative processes for making just decisions. Democratic deliberation seems therefore to provide a model of impartial decision-making applicable in the real world. However, various types of cognitive and affective biases limit individual capacity to see things from others’ perspectives. In this paper, two strategies of enhancing impartiality in real world (...) decision-making are discussed. The first involves decision-making processes which detach decision-makers from their particular interests, whereas the second aims to enhance the quality of democratic deliberation and empathetic reasoning. We conclude that new forms of democratic deliberation may be necessary if we hold on to the aspiration of making decisions which are both democratic and impartial. (shrink)

This paper analyzes the main features of rational choice theory and evaluates it with respect to the conceptions of Lakatos' research program and Laudan's research tradition. The analysis reveals that the thin rationality assumption, the axiomatic method and the reduction to the micro level are the only features shared by all rational choice models. On these grounds, it is argued that rational choice theory cannot be characterized as a research program. This is due to the fact that the thin rationality (...) assumption cannot be understood as a hard core in Lakatos' terms. It is argued that Laudan's conception of a research tradition better characterizes rational choice theory. On the basis of this conclusion, certain important criticisms of rational choice theory are answered. First, the criticisms concerning the core assumptions of rational choice theory are countered. It is argued that this critique is based on a misunderstanding of rational choice theory as a unified set of models, such as Lakatos' research program. Second, Green and Shapiro's rational choice 'pathologies' - inconsistent predictions, post hoc theory development and arbitrary domain restrictions - are evaluated. Contrary to Green and Shapiro, it is argued that post hoc theory development is a more preferable strategy for developing RCT than domain restrictions based on ex ante rules. (shrink)

‘Intersectionality’ has taken on a complex position in the field of feminist scholarship over the last decade. Debate on the concept has swung back and forth, from buzzword to harsh critique. Amid these discussions, many feminist scholars have thought about Audre Lorde and the role of her writings in the debates over intersectionality. Lorde’s radical literary feminism has often been seen both as reflecting a politics of identity, on the one hand, and as shifting and situational, on the other. Intersectionality (...) has also been claimed either to be recycling the ideas of identity politics or to be forging new ways to grasp decentered identity positions and power structures. This article aims to tell a story about the roots of intersectionality through – and alongside – the legacy of Lorde’s feminism, by revisiting certain identity-political ideas. The radical nature of Lorde’s thinking is in many ways connected to politicized writing styles and rebellious literary forms. The main focus in this article is therefore extended to cover the role and implications of radical writing styles for intersectionality. The article argues that the oeuvre of telling the story of intersectionality through Lorde’s feminism opens up a new perspective on the genealogy of intersectionality. (shrink)

World political processes, such as wars and globalisation, are engendered by complex sets of causes and conditions. Although the idea of causation is fundamental to the field of International Relations, what the concept of cause means or entails has remained an unresolved and contested matter. In recent decades ferocious debates have surrounded the idea of causal analysis, some scholars even questioning the legitimacy of applying the notion of cause in the study of International Relations. This book suggests that underlying the (...) debates on causation in the field of International Relations is a set of problematic assumptions and that we should reclaim causal analysis from the dominant discourse of causation. Milja Kurki argues that reinterpreting the meaning, aims and methods of social scientific causal analysis opens up multi-causal and methodologically pluralist avenues for future International Relations scholarship. Accountability is present in many types of social relations; for example, the accountability of elected representatives to voters is the key characteristic of representative democracy. We distinguish between two institutional mechanisms of accountability, i.e., opportunity to punish and requirement of a justification, and examine the separate and combined effects of these mechanisms on individual behavior. For this purpose, we designed a decision-making experiment where subjects engage in a three-player trust game with two senders and one responder. We ask whether holding (...) the responder accountable increases senders’ and responders’ contributions in a trust game. When restricting the analysis to the first round, the requirement of justification seems to have a positive impact on senders’ contributions. When the game is played repeatedly, the experience of previous rounds dominates the results and significant treatment effects are no longer seen. We also find that responders tend to justify their choices in terms of reciprocity, which is in line with observed behavior. Moreover, the treatment combining punishment and justification hinders justifications that appeal to pure self-interest. (shrink)

A common worry regarding normative supervenience theses is that they are easily trivialized unless we somehow restrict the set of descriptive base properties on which the normative properties supervene. The idea is that if all descriptive properties are included in the base, any two individuals that share all their base properties must be the same individual in the same world, from which it follows that they have the same normative properties. We argue that this trivial explanation for unrestricted normative supervenience (...) fails. Moreover, we argue that even if it succeeded, this wouldn’t undermine the explanation challenges associated with normative supervenience. (shrink)

The key stakeholders of the Finnish engineering education collaborated during 2006–09 to reform the system of education, to face the challenges of the changing business environment and to create a national strategy for the Finnish engineering education. The work process was carried out using participatory work methods. Impacts of sustainable development (SD) on engineering education were analysed in one of the subprojects. In addition to participatory workshops, the core part of the work on SD consisted of a research with more (...) than 60 interviews and an extensive literature survey. This paper discusses the results of the research and the work process of the Collaboration Group in the subproject of SD. It is suggested that enhancing systematic dialogue among key stakeholders using participatory work methods is crucial in increasing motivation and commitment in incorporating SD in engineering education. Development of the context of learning is essential for improving skills of engineering graduates in some of the key abilities related to SD: systemic- and life-cycle thinking, ethical understanding, collaborative learning and critical reflection skills. This requires changing of the educational paradigm from teacher-centred to learner-centred applying problem- and project-oriented active learning methods. (shrink)

This paper explores the prospects of a combinatorial account of modality. We argue against David M. Armstrong’s version of combinatorialism, which seeks to do without modal primitives, on the grounds, among other things, that Armstrong’s basic ontological categories are themselves subject to non-contingent constraints on recombination. We outline an alternative version, which acknowledges the necessity of modal primitives, at the level of ontology, and not just of our concepts.

I argue that Jonas Olson’s argument from irreducible normativity is not a secure basis for an argument for error theory and that a better basis is provided by the argument from supervenience, which has more bite against non-naturalist moral realism than Olson is willing to allow. I suggest there may be a view which can allow for the existence of irreducibly normative facts while remaining unaffected by the kinds of arguments that work against non-naturalist realism. This view is expressivism. Interestingly, (...) James Dreier has recently suggested that expressivism may not escape these arguments. I very briefly outline possible response strategies for expressivists. I close by discussing Olson’s argument against expressivism. Olson suggests, somewhat surprisingly, that expressivism is a bad fit with a plausible evolutionary explanation of our moral thought. I argue that Olson’s argument does not succeed. (shrink)

In this paper the 'moral fetishism' argument originally presented by Michael Smith against moral judgment externalism is defended. I argue that only the internalist views on the relation of moral judgment and motivation can combine two attractive theses: first, that the morally admirable are motivated to act on the reasons they take to ground actions' being right, and second, that their virtuousness need not be diminished by their acting on their thinking something right. Lastly, some possibilities are envisaged for internalists (...) in light of a worry to the effect that the argument, if successful, undermines the internalist theories, too. (shrink)

Belief normativism is roughly the view that judgments about beliefs are normative judgments. Kathrin Glüer and Åsa Wikforss suggest that there are two ways one could defend this view: by appeal to what might be called ‘truth-norms’, or by appeal to what might be called ‘norms of rationality’ or ‘epistemic norms’. According to G&W, whichever way the normativist takes, she ends up being unable to account for the idea that the norms in question would guide belief formation. Plausibly, if belief (...) normativism were true, the relevant norms would have to offer such guidance. I argue that G&W’s case against belief normativism is not successful. In section 1, I defend the idea that truth-norms can guide belief formation indirectly via epistemic norms. In section 2, I outline an account of how the epistemic norms might guide belief. Interestingly, this account may involve a commitment to a certain kind of expressivist view concerning judgments about epistemic norms. (shrink)

The chapter argues that the traditional theories of legal personhood, which associate legal personhood with the holding of rights, are outdated and should be reassessed. Many modern theories of rights come into conflict with our convictions regarding who or what is a legal person. For instance, most jurists would agree that foetuses are not natural persons but new-born children are. However, if we apply the so-called interest theory of rights, we will note that foetuses hold various rights, such as rights (...) against certain forms of abortion. If right-holding entails legal personality, then foetuses are already legal persons. On the other hand, if we apply the will theory, which associates right-holding with the power to control others’ duties, then infants do not hold any rights at all – and are consequently not legal persons. This is why the chapter outlines an alternative theory of legal personhood. The main tenets of the theory are: (1) legal personality is not binary but rather a matter of degree, and (2) X’s legal personality involves primarily the endowment of X with incidents of legal personhood, much like ownership can be understood as consisting of separate but interconnected incidents. Rather than being a “solved” theoretical issue, the definition of legal personhood should occupy theorists more in the future. (shrink)

A relatively recent form of animal activism is lawsuits intended to declare some animals as legal persons. A pioneer of this approach is the U.S.-based Nonhuman Rights Project. This organization’s primary strategy has been to invoke the writ of habeas corpus, which protects the right to personal freedom of “persons.” The article criticizes the notion of legal personhood that the NhRP is employing and explains how an alternative understanding of legal personhood could perhaps make nonhuman rights more palatable for courts.

Child abuse within the family is a highly sensitive issue and therefore difficult to research. This article is based on our experiences of a child abuse research project in Finland. Special attention is given to ethical considerations during the initiation of the study, and in the sampling procedures, data collection and reporting. Most importantly, all those taking part in studies on sensitive issues must be guaranteed full confidentiality and anonymity. There are also other ethical considerations that go beyond the usual (...) concerns in the research process. (shrink)

We investigated the longitudinal links between parental teaching of reading and spelling and children’s word reading and spelling skills. Data of 244 Lithuanian parent–child dyads were analyzed, who were followed across three time points: end of kindergarten (T1;Mage= 6.88; 116 girls), beginning of Grade 1 (T2), and end of Grade 1 (T3). The children’s word reading and spelling skills were tested, and the parents answered questionnaires on the frequency with which they taught their children reading and spelling. Overall, the results (...) showed that the parents were responsive to their children’s skill levels across the domains of reading and spelling and across time (i.e., the transition from kindergarten to Grade 1 and across Grade 1). However, differences between the domains of reading and spelling were also observed. In particular, in the domain of reading and across the transition from kindergarten to Grade 1, the parents responded to their children’s skill levels by increasing the time spent teaching children with poor word reading skills, and decreasing the teaching time for the children with good word reading skills. In contrast, as spelling skills may require more time to develop, parents maintained similar frequencies of teaching spelling across the transition to Grade 1 for all children, and only parents of good spellers taught less spelling at the end of Grade 1 than parents of children with poor and average word spelling skills. Although present research shows that ambitious corporate sustainability objectives improve employee engagement in business organizations, there is scarcity of research showing how employees engage in corporate sustainability objectives and become autonomous sustainability thinkers. We suggest that a strong, individual level of psychological ownership of corporate sustainability is a precondition for the development of sustainability thinking, and examine the factors that influence the emergence of such feelings of ownership. Our qualitative study, based on 29 interviews conducted in seven Finnish local business (...) units from three different technology-oriented multinational enterprises (MNEs), shows that several key factors can have contradictory effects, both strengthening and hindering the routes to psychological ownership of corporate sustainability. While these contradictory effects may potentially lead to confusion among employees, our findings may help managers to avoid pitfalls in developing a more sustainability-oriented organizational culture. Background Shared responsibility is an essential part of family-centred care and it characterizes the relationship between parents and healthcare professionals. Despite this, little is known about their shared responsibility for decision-making in neonatal intensive care units. Aim The aim of this scoping review was to identify previous studies on the subject and to summarize the knowledge that has been published so far. Method The review was conducted using electronic searches in the CINAHL, PubMed, Scopus and PsycINFO databases and manual searches (...) of the reference lists of the selected papers. The searches were limited to peer-reviewed papers that had been published in English from 2010 to September 2021. The data were selected based on inclusion and exclusion criteria and the findings were inductively summarized. We identified eight papers that met the inclusion criteria. Ethical considerations: The scoping review was conducted according to good scientific practice by respecting authorship and reporting the study processes accurately, honestly and transparently. Results The results showed that shared responsibility for decision-making was based on the parents’ intentions, but the degree to which they were willing to take responsibility varied. The facilitating and inhibiting factors for shared responsibility for decision-making were related to the communication between parents and professionals. The impact was related to the parents’ emotions. Conclusion It is essential that parents and professionals negotiate how both parties will contribute to their shared responsibility for decision-making. This will enable them to reach a mutual understanding of what is in the infants’ best interests and to mitigate the emotional burden of decisions in neonatal intensive care units. More research is needed to clarify the concept of shared responsibility for decision-making in this intensive care context. (shrink)

The Article analyzes the notion of legal “thinghood” in the context of the person–thing bifurcation. In legal scholarship, there are numerous assumptions pertaining to this definition that are often not spelled out. In addition, one’s chosen definition of “thing” is often simply taken to be the correct one. The Article scrutinizes these assumptions and definitions. First, a brief history of the bifurcation is offered. Second, three possible definitions of “legal thing” are examined: Things as nonpersons, things as rights and duties, (...) and things as property. The first two definitions are rejected as not being very interesting or serving any heuristic function. Conversely, understanding legal things as property is meaningful, useful, and helps to understand what it means to say that animals are legally things. Defining things as property has certain rather important implications, which are analyzed at the end of the Article. For instance, not everything needs to be either a person or a thing: The historical institution of outlawry involved treating individuals neither as legal persons nor as legal things. One must conclude that the person–thing bifurcation is less fundamental than is often assumed. (shrink)
